These Terms and Conditions govern access to and use of the ecnobis.com site and the services offered by Ecnobis Financial Technologies S.A.S. By registering or using the site you expressly accept these terms.
1. Identification
Ecnobis Financial Technologies S.A.S., Tax ID 1793224816001, with legal address at Av. República del Salvador N36-140, Mansión Blanca Building 7th floor, Quito 170135, Ecuador. Incorporated on March 8, 2022 in the Canton of Quito.
2. Purpose
Ecnobis is a technology platform that connects real estate developers seeking financing with investors willing to grant loans secured by mortgage. Ecnobis does not take deposits from the public, does not grant credit on its own account and does not provide personalized financial advice.
3. User registration
To invest you must be of legal age, hold an Ecuadorian ID or passport, have a bank account with an Ecuadorian bank and complete the due diligence process (KYC) according to UAFE regulation.
4. How operations work
Each operation is documented through a loan contract with mortgage collateral registered at the corresponding Property Registry. The rate, term, payment plan and collateral are published before the closing and cannot be modified once the contract is signed.
5. Fees
Ecnobis charges an origination fee to the developer and a servicing fee to the investor, both disclosed in the project profile. There is no fee for registration nor for maintaining the account.
6. Risks
The investor acknowledges that real estate crowdlending is not covered by the Deposit Insurance Corporation (COSEDE) nor by any other guarantee fund. Returns are not guaranteed and part or all of the capital may be lost.
7. Intellectual property
All content on the site (texts, logos, graphics, code) is property of Ecnobis or licensed. Total or partial reproduction is forbidden without written authorization.
8. Data protection
The processing of personal data is governed by the Privacy Policy, available on this same site and compliant with Ecuador's LOPDP.
9. Amendments
Ecnobis may amend these terms by publishing the new version on the site. Substantial changes will be notified with 30 days notice to the registered user's email.
10. Applicable law and jurisdiction
These terms are governed by the laws of the Republic of Ecuador. Any dispute will be submitted to the competent courts of the Metropolitan District of Quito, with express waiver of any other jurisdiction.
